Terms of Service

These terms govern your use of AETHER Fitness (“AETHER,” “we,” “us”). By using our website, tools, assessments, or membership, you agree to them. If you don’t agree, please don’t use the service.

What AETHER Is

AETHER is software that helps personal trainers understand the psychological factors behind client retention. Clients complete an assessment; AETHER analyzes the responses and returns a report scoring retention risk across a set of psychological factors, along with suggested coaching actions.

Important: This Is Not Medical or Psychological Advice

Please read this section carefully. AETHER is an educational and behavioral coaching tool. It is not a medical device, a clinical assessment, a psychological diagnosis, or therapy — and it is not a substitute for advice from a qualified doctor, therapist, or licensed mental health professional.

Our assessments and reports are informational. They do not diagnose or treat any medical or psychological condition. Never disregard professional medical advice, or delay seeking it, because of something you read in an AETHER report. If you or a client may be experiencing a mental health crisis, contact a licensed professional or emergency services.

Similarly, nothing on this site is medical clearance to exercise. Trainers remain fully responsible for their own professional judgment, scope of practice, and the safety of their clients.

Your Account

• You must be at least 18 years old to use AETHER.
• Give us accurate information when you sign up, and keep it current.
• Keep your password secure. You’re responsible for activity under your account.
• Let us know promptly if you believe your account has been compromised.

Membership and Billing

• AETHER membership is $25 per month, billed on a recurring basis.
• Payments are handled by Stripe. By subscribing, you authorize recurring charges until you cancel.
• You can cancel at any time. No contracts, no commitments. Your membership stays active through the end of the period you’ve already paid for, and you won’t be billed again after that.
• If we ever change the price, we’ll tell you in advance and you can cancel before it takes effect.

Acceptable Use

Please don’t:

• Resell, sublicense, or redistribute AETHER or its reports as your own product.
• Scrape, copy, or reverse-engineer the service or its assessment content.
• Attempt to break, overload, or gain unauthorized access to the service.
• Use AETHER for anything unlawful, or to harass or harm anyone.

Your Clients’ Data

If you send AETHER assessments to your own clients, you’re responsible for having their permission to collect and process their responses, and for handling the reports you receive responsibly and confidentially. How we handle data is described in our Privacy Policy.

Intellectual Property

AETHER — including the assessment instrument, the underlying frameworks, the software, and the site content — belongs to us. You get a limited, non-exclusive, non-transferable right to use it while your membership is active. The reports generated for you are yours to use in your coaching practice; the platform that produces them is not.

No Guaranteed Results

We believe strongly in the psychology behind AETHER, and we’ll always be honest with you about it: we can’t promise specific results. Any retention figures, revenue estimates, or examples on this site are illustrations, not guarantees. Client retention depends on many things outside our control — including your coaching, your market, and your clients’ own circumstances.

Service Availability

The service is provided “as is” and “as available.” We work hard to keep it running, but we don’t guarantee it will be uninterrupted or error-free, and we may modify or discontinue features over time.

Limitation of Liability

To the fullest extent permitted by law, AETHER is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost clients, or lost revenue arising from your use of the service. To the extent we are found liable, our total liability is limited to the amount you paid us in the twelve months before the claim.

Ending Your Access

You can stop using AETHER and cancel your membership at any time. We may suspend or end access if someone materially breaches these terms — for example, by abusing the service or using it unlawfully.

Governing Law

These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or your use of AETHER will be brought exclusively in the state or federal courts located in Oregon, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these terms as the service evolves. If we make meaningful changes, we’ll update the “last updated” date above and, where appropriate, notify you by email. Continuing to use AETHER after a change means you accept the updated terms.
